Trailer Rental Agreement
1. Condition and Inspection
Renter acknowledges the trailer is in good working condition at the time of pickup. Both parties shall inspect and note any existing damage prior to rental. Renter agrees to return the trailer in the same condition, normal wear and tear excepted.
2. Late Fees
A late fee of "the total value of the trailers day rate" may be charged if the trailer is returned after the agreed time without prior notice and approval.
3. Use of Trailer

Trailer shall be used only for lawful purposes and in a safe and proper manner.

Renter shall not sublease or allow any other person to use the trailer without written consent.

Renter agrees to comply with all local, state, and federal towing and load regulations.

Maximum load capacity shall not be exceeded.
4. Maintenance and Repairs
Renter is responsible for routine care while in possession of the trailer. Any damage or mechanical issues must be reported immediately to the Owner. Renter shall not attempt major repairs without Owner’s written approval.
5. Liability and Insurance
Renter assumes full responsibility for the trailer from the time of pickup until it is returned.
Renter agrees to:

Carry valid vehicle insurance that covers towing and liability.

Be responsible for all damages, theft, loss, or accidents arising during the rental period.
Owner shall not be liable for any personal injury, property damage, or consequential loss incurred during use of the trailer.
6. Indemnification
Renter agrees to indemnify and hold harmless the Owner from any and all claims, damages, losses, or expenses arising out of Renter’s possession, use, or operation of the trailer.
7. Termination
Owner reserves the right to terminate this agreement and reclaim the trailer at any time if the Renter breaches any term of this agreement or uses the trailer in a negligent or illegal manner.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania.
9. GPS Tracking Disclosure
Renter acknowledges and agrees that the trailer is equipped with a Global Positioning System (GPS) tracking device.
The GPS is used for:

Location tracking for recovery in case of theft, loss, or unauthorized use.

Monitoring return times and route verification for safety and compliance.
Owner agrees that GPS data will only be used for legitimate business purposes related to the rental and protection of the equipment. Tampering with, disabling, or removing the GPS device is strictly prohibited and will result in forfeiture of the deposit and potential legal action.
10. Electronic Agreement and Payment Consent
By making payment for the rental, the Renter acknowledges that they have read, understood, and agreed to all terms and conditions of this Trailer Rental Agreement.
Payment shall constitute the Renter’s electronic signature and consent, binding them to the terms of this Agreement as if signed in person.
No physical signature is required for this Agreement to be valid and enforceable.
11. Entire Agreement
This document constitutes the entire agreement between Owner and Renter and supersedes all prior discussions or agreements. Any modifications must be in writing and acknowledged by both parties (including by electronic means such as email or text).
Acknowledgement
By submitting payment, the Renter confirms acceptance of this Agreement in full.
